Entity: IZA NOIR LLC ("Civica", "Civica Jamaica", "we", "us")

These Terms of Service ("Terms") govern your access to and use of Civica, a platform created and operated by IZA NOIR LLC, a United States based limited liability company. Civica is an online service accessible to individuals in Jamaica and other regions, providing tools for community reporting, transparency, and coordination during emergencies. By using Civica, you agree to these Terms. If you do not agree, do not access or use the Services.

1. About Civica

Civica is a public good community platform that enables users to share observations, needs, hazards, and information that supports relief efforts and community coordination. The platform is not a personal portfolio or social media site; it exists for transparency, community benefit, and accurate reporting.

Civica does not maintain a physical office or local legal establishment in Jamaica. All services are provided by IZA NOIR LLC in the United States.

2. Eligibility

You may use the Services only if you are at least 13 years old and legally able to agree to these Terms.

3. Your Responsibilities

3.1 Use the Services lawfully

You will comply with all applicable laws and will not upload unlawful, defamatory, harmful, or infringing content.

3.2 Contribute accurate community information

Civica relies on clear, truthful reporting for the benefit of everyone. You must not submit false information, fabricate needs or hazards, mislead responders or the community, manipulate or distort data, or attempt to disrupt or skew relief efforts.

3.3 No abuse or exploitation

You may not interfere with platform operations, attempt to bypass rate limits, engage in scraping, create multiple fake accounts, or use the map for malicious, deceptive, or harmful purposes.

3.4 Respect security safeguards

You acknowledge that the platform logs device information and assigns a visitor ID even if you are not signed in. These measures are used to detect and prevent abuse. If you do not agree, do not use the map.

4. Community Contributed Public Good Data

4.1 You retain copyright, Civica retains the data

You keep ownership of your contributions, but by submitting them you grant IZA NOIR LLC a perpetual, irrevocable, worldwide, non exclusive license to host, store, display, reproduce, distribute, use, create derivative works based on, and preserve your contributions for the purpose of operating Civica, supporting the public good, and maintaining accurate historical records.

4.2 Contributions remain permanently

Pins, needs reports, hazards, photos, and other community level contributions form part of the public good dataset and are not removed if your account is deleted, may be retained indefinitely, and may be used for historical, research, transparency, GIS, and relief coordination purposes. This ensures continuity, accuracy, and protection against manipulation of public records. If you do not agree, do not submit content to the map.

5. Offline Access and Local Caching

To allow Civica to function during outages or low connectivity events, the platform stores approximately 20 MB of data locally on your device, including cached map tiles, cached pins, and basic UI data. You can clear this data through your device or browser settings.

6. Device Information and Security Logging

To maintain platform integrity, Civica automatically collects and logs IP address, browser and device type, activity logs, rate limit interactions, and the assigned visitor ID. These measures are used solely to detect abuse, investigate misuse, and maintain a safe community environment.

7. Account Suspension or Termination

We may suspend or terminate your access if you violate these Terms, submit harmful or intentionally misleading information, attempt to exploit or manipulate the map, or if your activity poses risk to the community or platform integrity. We may also remove content that violates these Terms.

8. Payments

Civica does not currently offer paid features. If payments or premium features are introduced later, we will provide updated billing terms.

9. Disclaimers

The Services are provided "as is" without warranties of any kind. We do not guarantee uninterrupted access, error free operation, perfect data accuracy, or the availability of third party services such as map providers, CDNs, or hosting. Civica is a tool that supports community coordination but does not replace official emergency services.

10. Limitation of Liability

To the fullest extent permitted by law, IZA NOIR LLC is not liable for indirect, incidental, special, or consequential damages. Our aggregate liability is limited to the total amount you paid for the Services in the 12 months before the claim, if any. Some jurisdictions do not allow certain limitations, so portions may not apply.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of Florida, United States. Where permitted by law, disputes will be resolved through binding arbitration, class action claims are waived, and claims must be filed individually.

12. Changes to These Terms

We may update these Terms from time to time. If material changes occur, we will provide reasonable notice through the platform.
